On April 25, Guangming Furniture was confiscated by the Taoshu County High-speed Wood Inspection Station of the Shuliang County, Jiangxi Province, on the grounds of transporting solid wood finished furniture, and was required to reissue the certificate and impose a fine of 30,000 yuan.
The relevant person in charge of the company questioned that according to the documents issued by the State Forestry Administration in 1998, the finished furniture and wood (bamboo) crafts with wood and bamboo as auxiliary materials were not included in the scope of voucher transportation. Why did Jiangxi not implement national forestry? Bureau policy?
The Jiangxi Provincial Forestry Department Timber Circulation Supervision Administration responded that the penalty is based on the “Jiangxi Province Voucher Transport Timber Listâ€. According to this catalogue, transporting furniture also requires a certificate of timber transportation.

Transporting 384 pieces of furniture was stopped by the timber checkpoint
On the evening of April 25th, Guo Hongwei, a driver from Jinan, Shandong, drove a large truck on the Jingying Expressway. The car was a solid wood furniture of Nanchang Marketing Branch of Guangming Group Co., Ltd., and the destination was Langfang, Hebei.
In the Wannian toll station service area, Guo Hongwei ended the break after a meal and returned to the truck cab to prepare to drive away. He was stopped by the inspectors of the Taoshu High-speed Wood Inspection Station in Fuliang County.
Several uniformed inspectors climbed into the car and scratched the canvas and furniture packaging on the truck and said, "Looking at the wood, what about your timber transport certificate?"
Guo Hongwei quickly explained: "Although the goods are made of wood, they can now become furniture goods. Why do you need a transport permit?"
“There is no transportation certificate, all confiscated!†the inspector said, “You drive to the Jingdezhen parking lot to accept the punishment!â€
In desperation, Guo Hongwei contacted the owner while driving the car away from the high speed.
Guo Hongwei told the new law report reporter: "I have transported many solid wood furniture, this is the first time I heard that I need a transport permit."
Guo Hongwei said that when he returned to the parking lot, the inspectors not only had to confiscate the goods, but also imposed a fine of 30% of the value of the goods. He calculated it and the fine was 24,000 yuan!
Guo Hongwei contacted Liu Zhijun, general manager of Nanchang Marketing Company of Guangming Group Co., Ltd.
After hearing about the incident, Liu Zhijun was very surprised and hurriedly contacted a friend in Jingdezhen. The next day, a friend commissioned by Liu Zhijun got in touch with the staff of the Taoshu Expressway Timber Checkpoint, but the timber checkpoint insisted on confiscating the 384 cabinets.
Is it necessary to carry a timber transport permit for transporting solid wood furniture?
On April 26, the staff of the Jiangxi Fuliang Taoshu Expressway Timber Inspection Station issued a forestry administrative penalty decision letter for the solid wood furniture that was unlicensed for transportation. In this penalty document of Yulin Penalty [2013] No. 07013, it is clearly visible that the nature of the case is unlicensed transportation; the penalty is determined as: 384 pieces of solid wood furniture illegally transported.
The law enforcement officers of the Taoshu Expressway Timber Checkpoint are based on the “Regulations on the Implementation of the Forest Law†and the “Measures for the Supervision and Administration of Timber Transportation in Jiangxi Provinceâ€.
Article 44, paragraph 1, of the Regulations for the Implementation of the Forest Law stipulates that if timber is transported without a timber transport permit, the illegally transported timber shall be confiscated, and the seller may concurrently impose a fine of less than 30% of the illegally transported timber price; Article 22 of the Measures stipulates that if the unlicensed timber is carried, the carrier shall be confiscated the freight and shall be imposed a fine of 1 to 3 times the freight.
Guo Hongwei told reporters that the law enforcement officers at the checkpoint said: "Jiangxi Province expressly stipulates that timber transport permits must be handled for transporting solid wood furniture, but for the purpose of reducing losses, the person being punished can pay the price of the timber and the relevant fine. Take it away."
The friend entrusted by Liu Zhijun then paid 30,000 yuan to the timber inspection station, and the timber inspection station issued a “Special Bill B for the Collection of Jiangxi Forestry Forestry Fundâ€. The fee-based fund project is “6000 yuan for solid wood furniture forestry fund, and the price of wood bamboo is confiscated according to law, 24,000 yuan.â€
The law enforcement officers applied for a timber transport certificate after they paid the fine and attached an administrative penalty. After that, Guo Hongwei successfully transported the solid wood furniture to Langfang, Hebei.
Although he paid a fine, Liu Zhijun still questioned. In 1998, the State Forestry Administration issued the "Notice on Further Regulating the Relevant Issues Concerning the Management of Timber Voucher Transportation" (Lin Zi Tong Zi [1998] No. 86). The document stipulates that finished furniture and wood (bamboo) crafts based on wood and bamboo, and auxiliary materials are not included in the scope of voucher transportation.
At the same time, the fine bills levied special bills for the forestry “forestry fund†in Jiangxi Province, which also made him a bit puzzled. What is the relationship between the voucher transport and the Yulin Fund? Liu Zhijun said: "The furniture for this transportation was produced at the headquarters in Yichun City, Heilongjiang Province. It is not processed and produced in Jiangxi. The transportation furniture is the transfer between enterprises. Guangming Group pays the forestry fund every year in Yichun. Why? Also paying the Yulin Fund in Jiangxi?"
